HOW TO MAKE A CLAIM
For items of a non-emergency nature, send a clear and specific written description and request for service to:

Be certain to include home and work telephone numbers.

For items of an emergency nature only, that is, a situation, which if not attended to immediately threaten to make the home unsafe, unsanitary or unlivable, the Warrantee may take necessary steps to cure the immediate effect and prevent further damage. Warrantor will consider claims for reimbursement of expense for such emergency actions under the following conditions.

1. The situation was a true emergency.

2. The situation was caused by or due to a defect covered by this Warranty.

Provided, however, that Warrantor reserves the right to modify or reject any claim for which the costs unreasonably exceed prevailing wage or material costs typical for the area.
 
Alteration and Enforceability
This Warranty cannot be changed or altered in any way. Should any provision of this Warranty be deemed by a court of competent jurisdiction to be unenforceable, that determination will not affect the enforceability of the remaining provisions.

BUILDER MUST RECEIVE WRITTEN NOTICE OF ANY DEFECT ON ITEMS COVERED BY THE LIMITED WARRANTY WITHIN A REASONABLE AMOUNT OF TIME AFTER THE DEFECT OCCURS, OR AFTER IT IS FIRST NOTICED, BUT IN NO EVENT LATER THAN THE EXPIRATION OF THE APPLICABLE WARRANTY PERIOD. ALL DEFECTS REPORTED AFTER AN UNREASONABLE DELAY OR AFTER THE EXPIRATION OF THE APPLICABLE WARRANTY PERIOD WILL NOT BE COVERED.
